Use Agreement

NOTICE: By using The Indoor Dog Park property or services in any way, you agree to abide by all terms and conditions in this Agreement. This Agreement is legally binding.

Use Agreement ("Agreement" or "Terms and Conditions")


The Agreement is effective ("Effective Date") immediately upon use of any The Indoor Dog Park property or service by the primary contact ("Member" or "Guest").

Purpose of the Agreement

At The Indoor Dog Park, we believe in fun, safety, cleanliness, and sophisticated autonomy for all Guests. The Park is a direct reflection of the quality of our Guests and the following agreement is put in place to ensure a great experience for all. Remember, as a Guest of The Indoor Dog Park, you are part of a tight-knit community of responsible dog owners. Treat other Guests as your family and the Park as you would your own home.

This Agreement includes a release of liability and waiver of legal rights and deprives you the right to sue the owner(s) of any The Indoor Dog Park location or related parties. Do not accept these Terms and Conditions and do not use The Indoor Dog Park property or services unless you have read and understand this Agreement in its entirety. Seek the advice of legal counsel if you are unsure of its effect.

In consideration for your dog(s) being permitted to come to the Park or use any Park services, you agree to all of the policies, procedures, release, terms and conditions set forth below. You also warrant that all information provided by you shall be true and correct. This Agreement applies at all Park locations.

Guest agrees to hold sole responsibility for all activity under their account and agrees to uphold all current and future policies, procedures, standards, and rules of The Indoor Dog Park. The primary Member or Guest on the account is responsible for all activity, whether present or not.

 

Authorized use covers only the dogs specified in your Membership Registration or Booking form submission and accepted by The Indoor Dog Park's verification process. A Guest may never bring an unauthorized dog to the Park or on Park property.

RESPONSIBILITY

As the primary contact on your account, you are responsible for all activity associated to your account, including any activity by your party or people that accompany you to the Park.

 

MEMBER ORIENTATION/TEMPERAMENT EVALUATION

A passing Temperament Evaluation is required for every dog prior to Membership. In the event that the dog described in the booking form does not pass the Temperament Test, the dog may not use the Park. You may schedule additional temperament evaluations after further training has been completed. Temperament Evaluations are performed by Park staff and the passing determination is made at the Park's sole discretion. Temperament Evaluations are done as part of the Orientation session.

SINGLE PLAY PASS

Single Play Pass Guests are under direct supervision of Park Staff at all times. If a Single Play Pass guest wishes to join the Park as a Member, Park staff may elect to waive the Member Orientation and Temperament Evaluation in lieu of satisfactory behavior exhibited by the registered dogs during the play session. The Indoor Dog Park reserves the right to deny this waiver for any reason or no reason at all.

Single Play Pass Guests are not automatically enrolled Members of the Park. By purchasing a Single Play Pass and scheduling your appointment, you agree to all Terms and Conditions set forth in this Agreement. You understand that nonconformity to any portion of the policies herewith may result in immediate termination of service and removal from the Park. This includes, but is not limited to unforeseen adverse behavior of your party or your dog(s), at the sole discretion of Park staff.

 

IMMUNIZATION RECORDS AND HEALTH STANDARDS

The Indoor Dog Park requires that all dogs must be up-to-date on Rabies, DHLPP/Da2PP, and Bordetella vaccinations at all times. Vaccine information provided by you will be verified with your veterinarian. As vaccination expiration dates approach, The Indoor Dog Park will work with your Vet to update Park records automatically and on your behalf. The Indoor Dog Park may require additional information from you in the event your Veterinarian is unable to provide adequate information. If The Indoor Dog Park is unable to obtain proof of current vaccinations, your membership may be terminated.

At Park staff's sole discretion, immunization requirements may be waived for dogs in which vaccination is not recommended for medical purposes.

You agree to provide veterinary records to the Park upon request, and you hereby grant the Park permission to request and obtain veterinary records directly from your designated veterinarian. You expressly authorize your designated veterinarian to release health and treatment information and immunization records to Park staff upon request.

At all times, your dog(s) must be free of fleas, ticks, mites, and parasites. You, your party, and your dog(s) will be asked to vacate premises in the event of evidence of fleas, ticks, mites, or parasites at the sole discretion of Park staff. All dogs entering the Park must be reasonably clean and well-maintained as to not unnecessarily dirty the Park.

 

PARK RULES

All Guests and any person accompanying a Guest must abide by Park Rules at all times. The rules may be amended from time to time and up-to-date rules are posted on the website. A summary of the Rules can be found throughout the Park. Any and all posted rules must be followed. Any behavior not in accordance to current rules is a violation of this Agreement, at the sole discretion of Park staff.

  • Guests are always legally responsible for the behavior of their dog and their party

  • Owners/Handlers may not leave their dog unattended at any time

  • Dogs must be in full view and within voice control of their handler at all times

  • A limit of 2 dogs per adult handler is allowed at one time

  • Dogs must be leashed before entering and when departing the Park

  • Except when entering and exiting, dogs must be unleashed on all turf areas. In non-turf areas, dogs must be leashed at all times

  • For quick access in case of emergency, it is recommended that the Handler carry the leash while the dog is in play

  • Barking and any other nuisance activity shall be under control at all times

  • Dogs must be properly licensed, vaccinated, and free of parasites

  • Aggressive dogs are not permitted - no fighting, biting, or demonstration of dominant or aggressive behavior. If your dog shows any sign of aggressive behavior, leave the Park immediately. Failure to comply may result in termination of your membership without notice.

  • Sick dogs, dogs in heat, and puppies under the age of 16 weeks are not permitted

  • Cleated shoes and high heels are not permitted

  • All amenities and equipment are for use by dogs only

  • All Guests will clean up after their dogs, themselves, and their Party

  • Disposable poop bags shall not be used inside the Park. Disposal of pet waste is to be done IMMEDIATELY and only in accordance to the Pet Waste Disposal policy.

  • Smoking, vaping, and alcohol consumption is not allowed on any Park property

  • Any food consumption shall be restricted to non-turf areas where dogs must remain leashed

  • If you experience any inappropriate behavior at the Park, it is your responsibility to report all issues to Park Staff

If guidelines posted on placards throughout the Park differ from this Agreement, posted placard guidelines shall be followed.


CHILDREN

Any child under the age of 18 must be accompanied and supervised by an adult and must be within arm's length of their accompanying adult at all times. Children under 6 years of age are not permitted in the Main Play area of Park. These children must be accompanied by a second adult and must remain in the lounge area or private room space. This includes babies in strollers or other carrying devices. Children may not yell, scream, or run in the Park. All agility equipment, toys, and balls are for use by dogs only. Children may not bring toys to the Park.

 

DOG TOYS, FOOD AND TREATS

The Park is designed for dog play only. Dog toys are encouraged. Person-to-person ball throwing is not permitted. To reduce risk of incidents caused by food aggression, dog food, chew toys, large treats, and chew bones are not permitted. To reward good behavior, small training treats are encouraged.

 

PET WASTE DISPOSAL

All dog waste must be cleaned up immediately. Wet waste (urine) shall be marked with a cone and the area shall be promptly sanitized using the provided sanitizing sprayer. Solid waste shall be marked with a cone, scooped with the provided scooper, deposited into the PowerLoo, and flushed into the sanitary sewer system. Disposable poop bags are not permitted. After flushing the waste, return to the affected area and use the provided sanitizing sprayer to thoroughly flush any residue from the grass.

POOL

The pool is for dog use only. There is no lifeguard on duty and it may be used at your own risk. Dogs are not permitted to run or play outside of the pool within the fenced area. Children are not permitted in the fenced pool area. 

 

POOR BEHAVIOR

At the Park's sole discretion, if you, a member of your party, or your dog(s) exhibit behavior that is not in accordance to this agreement or is deemed unacceptable, you, your party, and your dog(s) may be asked not to return to the Park and membership (if applicable) may be canceled without notice. Unacceptable behavior is at the Park's sole discretion. Refunds will not be granted in the event you, your party, or your dog(s) are unable to use the Park due to Poor Behavior.

 

PHOTO AND VIDEO RELEASE

By using the services offered by the Park, you agree to allow the Park and any of their affiliates to use you or your dog(s) name(s) and any image or likeness of you or your dog taken while at the park or at any event sponsored by the Park, in any format, for use, at any time, in any media, marketing, advertising, illustration, trade or promotional material. You agree not to screenshot, copy, reproduce, alter, modify, or create derivative works from the material. The Park may use video and audio surveillance on all Park property, and by using our services, you acknowledge and consent to the same.

 

PERSONAL PROPERTY

The Park will not be liable for any lost, stolen or damaged personal property belonging either to you or your party. If your dog(s) causes any damage to the Park or Park property, you will be liable for the full cost of all repairs or replacements.

 

MEMBER KEYFOB

You agree that, under no circumstance, you will not allow another party to use your keyfob to enter the Park unless the Other Party is acting on your behalf to enter the Park and accompany your dog which is already registered under your account. If your keyfob is lost or stolen you must contact the Park immediately so that the wristband can be disabled. You may be charged a $10 replacement fee for any lost, stolen, or broken keyfob. Upon termination of your membership, the keyfob must be returned to the Park. In some rare instances, keycards or wristbands may be provisioned in place of a keyfob. All rules still apply. MEMBERSHIP DUES AND FEES

Membership dues are processed monthly, starting the day you begin membership, and will continue on a month-by-month basis. All membership fees are collected automatically from a pre-authorized payment method. By providing your information, you allow The Indoor Dog Park to automatically withdraw dues and fees as they become due.

You give your express permission for the Park to charge any credit card you provided for unpaid services or products upon the date services were supposed to have been completed or provided.

In the event payment transactions are declined or cannot otherwise be processed, your Keyfob will be deactivated after the 5th day of non-payment and your Membership is terminated. If payment is later received, a $25 late payment fee will be due and payable prior to the reactivation of your membership and Keyfob.

If you know or should know you have a problem that might prevent you or your dog(s) from using the facility (including, but not limited to medical or family emergency, business travel, and vacation) and you acknowledge this Agreement, you agree that your membership is limited accordingly. However, you are responsible for dues and fees for the term of the Membership as if you could use the facility; there will be no carry-over of monthly dues into subsequent months for any time unspent using the facility in a previous month.

 

MEMBERSHIP CANCELLATION POLICY

Any Party may cancel Membership at any time. Written notice of cancelation must be provided to info@theindoordogpark.org with at least 5 days notice.

To reactivate a canceled Membership, send your request to info@theindoordogpark.org. Your request will be evaluated by Park Staff and may be rejected or accepted for any reason, at the Park Staff's sole discretion. If accepted, a Reactivation Fee may apply. Membership reactivations are evaluated on a case-by-case basis and may require attending a Membership Orientation/Temperament Evaluation. A previously passing evaluation may not suffice as a dog's temperament may change over time. 

MEMBERSHIP HOLD POLICY

In the event you or your dog are unable to utilize the Park for a defined and temporary timeframe (medical reasons, holiday, or other life events), you may request your membership to be but on hold by emailing your request to info@theindoordogpark.org with at least 5 days notice. Holds will be evaluated by Park staff and approved or denied on a case-by-case basis, at their sole discretion. After a membership has been placed on hold, the next scheduled payment is moved forward and all future scheduled payments will also be moved forward accordingly. All future payment dates are moved forward the same number of days that the membership is on hold. Upon 3 months of continuous hold, your membership will be cancelled. 

REFUND POLICY

All booking fees for any service, monthly Membership dues, professional services fees, and sales of goods are final and nonrefundable. If a booked session is canceled, you may be refunded the session fee minus any processing fees incurred upon written request to info@theindoordogpark.org at least 24 hours prior to the scheduled session. Refunds are not permitted for cancellations within 24 hours of your appointment. There are no refunds for gift certificates.

LATE ARRIVAL AND NO-SHOW POLICY

You are asked to arrive on time to any bookings/appointments. A grace period of 15 minutes will be permitted. If you are less than 15 minutes late, it is based on the Staff's sole discretion to determine if the remainder of your allotted time may be used for the originally scheduled purpose. If the Staff member deems the remaining time insufficient, you will be asked to reschedule and you will incur a $15 rebooking fee. If you choose to not reschedule, it is considered a cancellation and no refund will be given. A Guest is a "no show" if they fail to appear for their scheduled appointment after 15 minutes from the start of the appointment. In this event, the appointment is considered canceled and no refund will be given.

 

ABANDONED DOGS

You may not leave your dog(s) at the Park unattended at any time for any reason. You may not leave the building without your dog(s). If your dog is left unattended for any amount of time, the dog will be deemed "Abandoned". If your dog is Abandoned at the Park, the Park will become its legal owner and guardian. The Park will, in its sole discretion, determine whether to re-home the dog or relinquish it to a shelter or rescue of the Park's choice. You fully understand and agree that if you abandon your dog at the Park, you may be unable to retrieve possession of your dog and will have no recourse against the Park.

 

DUTY TO DISCLOSE

You must disclose on a continuing basis, any and all medical or other conditions, including but not limited to personality concerns or behavioral incidents that may affect, limit or prevent your dog's ability to participate in any activity at the Park or at Park sponsored events. In the event of a material change to the information you provided to us, you agree to notify Park staff within 7 days via email at info@theindoordogpark.org.

 

ACCEPTANCE AND ACKNOWLEDGEMENT OF RISK

The Indoor Dog Park is an unsupervised dog park. The Park is not responsible for any injuries to humans or dogs. You agree to abide by all posted safety guidelines and regulations while on Park property.

You fully understand that: (a) there are inherent and potential risks involved with interactions between humans and dogs, as well as between dogs and other dogs, which may result in property damage or bodily injury, including but not limited to, permanent disability, sickness or death to human or dog; and (b) there may be other risks not known to you or the Park, nor readily foreseeable at this time (collectively, "Risks"). You fully accept and assume all risks and responsibility for all risks, including, without limitation, all losses, costs and damages incurred as a result of your dog's participation at any Park activity, including any veterinarian expenses or medical expenses. "Sickness" includes any illness including but not limited to Bordetella (kennel cough), canine flu, or any other form of contagious disease.

If your dog is injured at the Park for any reason, as the Park staff determines, in their sole discretion, you agree to be fully responsible for all resulting costs related to any medical treatment for you, your dog(s), or your accompanying party, including without limitation, the cost of any transportation for the purpose of such treatment. If Park staff determines, at their sole discretion, that you, your dog(s) or your guests caused injury or death of another Park guest or dog(s), you will be fully responsible for all costs related to any medical treatment for the injured guests or dog(s), including without limitation, the cost of any transportation for the purpose of such treatment. You agree that the Park may release your name and phone number to the injured parties to arrange payment for the same.

 

WAIVER, RELEASE AND INDEMNIFICATION

You hereby agree to expressly and forever generally waive, discharge claims, indemnify, release from liability, save, hold harmless and defend the Park, their invitees, guests, owners, officers, directors, employees, contractors, volunteers, agents, representatives, lessors, and all others having any interest in any Park party (collectively, the "Releases") from and against any and all injury, liability, claims, litigation, actions, suits, costs, losses, damages, attorney's fees, expenses or demands of every character whatsoever on account of, arising out of, resulting from or relating in any way to (i) any act or omission of the Releases, (ii) you, your dog(s), or your guests participation in Park activities or Park sponsored activities, or otherwise. You agree that this release is binding on you and your successors, heirs, legal representatives, and assigns. You also expressly and forever release the Park from any duty to protect you or your dog(s) from injury of any kind, and agree that any implementation of safety precautions by the Park will not waive the Park's right to be indemnified as provided hereunder, and such precautions will not alter this release. You agree that this constitutes a complete and unconditional release of all liability of the Park to the greatest extent permitted by law, and that if any portion of this Agreement is held to be invalid or unenforceable, the remainder of this Agreement will remain in full force and effect.

 

AVAILABILITY OF FACILITY

The general business hours of the Park is 24 hours per day, 365 days per year. On occasion, the Park reserves the right for periodic closures for specialized cleaning and maintenance work to ensure the health, safety, and wellbeing of our guests. Closures may be unexpected and the Park does not guarantee access to any or all amenities at all times. Refunds will not be granted due to unavailability.

 

SIGNATURES

By utilizing Park property and Park services, you represent and warrant that all information you provide is complete and accurate to the best of your knowledge, You consent to the Park's use of such information for all lawful business purposes which includes but is not limited to, providing services to you, operating the business, marketing to you, communicating with you, and using data that includes information about you and your dog(s) for marketing and other purposes. You agree that the Park may send you email and/or SMS messages regarding your transactions with the Park, including but not limited to reminders, reservations, correspondence, information and pictures, and that your decision to opt in or opt out of marketing communications does not limit or prohibit the Park's ability to communicate with you regarding these transactional matters. You further acknowledge and agree that you have read, understand and agree to all the terms and conditions contained in this Agreement, as they may be amended from time to time. You hereby execute this Agreement for your dog(s), yourself, your guests and your heirs successors, representatives and assigns. You further attest that if you are not the owner or sole owner of the dog(s) noted in this Agreement, your acknowledgement is sufficient to enter into this Agreement for and on behalf of any other owner or representative. You consent to the use of electronic signatures for this and subsequent documents, and agree that a true and correct copy of this document may be produced in lieu of the original document. Should a copy be produced, you agree that it is legally enforceable and does not affect the terms of the Agreement in any way. 

 

BINDING LAW

This Agreement shall be considered binding upon the Guest and Park, and shall be upheld and enforced in accordance with the laws of Pennsylvania. Any legal proceedings related to this membership Agreement shall take place in courts located in Butler County, Pennsylvania.

SEVERABILITY

If any portion of this Agreement is deemed to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force, if the essential provisions of this Agreement for each party remain legal and enforceable.

 

AMENDMENTS

Use Agreement terms may be amended from time to time at the sole discretion of the Park. Any modifications to this Agreement will be effective immediately upon posting of such modification. It is your responsibility to review the Use Agreement each time you participate or use the Park, Park Property or Park Services so that you are aware of any modifications made. Usage of the Park, Park Property, or Park Services means you accept the then current rules and form of the Agreement. For your convenience and future reference, the date of the current version of this Agreement is noted below. By continuing to utilize the Park, Park Property or Park Services following the posting of a revised Agreement, you are agreeing to any changes in the revised Agreement.
